Court & Judicial System

judgesAs in most other sectors of society, leading positions within the legal system were taken over by officials loyal to the Nazi regime. The new president of the Regional Court, Walter Müller, was an especially strict proponent of National Socialism. All judges were obliged to swear an path of allegiance, not to the government, but to Adolf Hitler himself as head of state. The Special Courts, established in 1933, were to be particular instruments of political justice. At first, they focused on members of the opposition, criticism against the Nazi government or insults against the party.

As of the start of the war, they also dealt with ‘regular’ crimes that were considered particularly ‘condemnable’ or dangerous. In the proceedings at the Special Courts, the principles of the rule of law were completely overridden. After the beginning of the war, the Special Courts began pronouncing more and more drastic judgments. The death penalty could be imposed for even petty crimes, at the whim of the court.
